Welcome to Kite & Wing. By purchasing products or services from us, you agree to the following terms and conditions.
These Terms and Conditions govern the use of our services, including the sale of kitesurfing and wingsurfing equipment, repair services, and maintenance by Kite & Wing in Stuart, Florida. By purchasing products or using our services, you agree to these Terms and Conditions. If you do not agree, please refrain from using our services or making a purchase.
1. Services and Products Offered
We provide:
• Kitesurfing and Wingsurfing Equipment Sales: new and used kites, wings, boards, bars, lines, and related accessories.
• Repair Services: professional repair and maintenance for kites, wings, boards, bars, and other equipment.
• Custom Orders: assistance in sourcing specialized kitesurfing gear or parts.
2. Sales Terms
2.1 Product Availability
• All products are subject to availability. In case of stock shortages, we will notify you promptly and offer alternatives or a refund.
• For custom or special orders, we may require a deposit of 50% upfront, which is non-refundable unless the order cannot be fulfilled by us.
2.2 Pricing
• Prices are displayed in USD and do not include sales tax. Applicable taxes will be added at checkout.
• We reserve the right to change prices without prior notice. Orders placed before a price change will not be affected.
2.3 Payment
• Payment is required in full at the time of purchase or upon collection of repaired items, unless otherwise agreed.
• Accepted payment methods: PayPal, credit card, cash.
2.4 Returns and Refunds
• All sales are final – no returns or exchanges.
• Florida-Specific Laws:
New Products: Returns are accepted within 14 days of purchase if the product is unused, in original packaging, and accompanied by proof of purchase. Refunds will be issued in the original form of payment.
Used Products: All sales of used items are final unless the product is defective and not as described at the time of sale.
Florida law requires refunds for defective products if a repair or replacement is not possible.
3. Repair and Maintenance Terms
3.1 Assessment and Estimates
• We will inspect your equipment and provide an assessment and cost estimate before starting any work.
• If additional repairs are needed, we will notify you and seek your approval before proceeding.
3.2 Repair Warranty
• Repairs are warranted against defects in workmanship for 30 days from the completion date.
• Warranty claims will not be honored if the equipment has been misused, neglected, or subjected to extreme conditions.
3.3 Customer Responsibility
• Items submitted for repair must be clean, dry, and free of sand. A cleaning fee of $50 may apply if this condition is not met.
• Customers are responsible for collecting repaired items within 30 days of notification.
3.4 Liability
• While we take great care in handling your equipment, we are not liable for:
Pre-existing damage or defects.
Damage resulting from improper use after repairs.
Equipment loss or damage caused by circumstances beyond our control.
4. Shipping and Delivery
• We offer shipping for products and repaired items upon request. Costs and timelines will be provided at the time of order.
• We are not responsible for delays caused by third-party carriers.
• Customers are responsible for verifying shipping details. Incorrect information may result in additional charges or delays.
• Risk of loss or damage passes to the customer once items are handed to the carrier.
5. Uncollected Items
• Repaired items not collected within 90 days will be considered abandoned in accordance with Florida Statutes Section 713.78. We reserve the right to sell or dispose of abandoned equipment to recover costs.
6. Customer Data
• Personal data collected during transactions or repairs will be used solely to fulfill orders, manage our services, or comply with Florida state laws.
• We do not share customer information with third parties, except as required to process payments or ship items.
7. Liability Disclaimer
• Kitesurfing and Wingsurfing is an inherently risky activity. Customers must have proper training and experience before use. All use is at the customer’s own risk.
• We are not liable for injuries, accidents, or damages resulting from the use of equipment purchased or repaired through us.
• It is the customer’s responsibility to inspect and maintain their equipment and to use it in accordance with the manufacturer’s instructions.
• Our liability shall in no event exceed the purchase price of the product or service.
8. Warranties
• Certain new products may be covered by manufacturer warranties. Warranty claims must be handled directly with the manufacturer.
• Kite & Wing does not provide additional warranties beyond those required by law or specifically stated in these Terms (e.g., 30-day repair warranty).
9. Force Majeure
• Kite & Wing shall not be held liable or responsible for any delay or failure to perform due to events beyond our reasonable control, including but not limited to natural disasters, extreme weather, acts of government, labor disputes, power outages, or supply chain disruptions.
10. Governing Law
• These Terms and Conditions are governed by the laws of the State of Florida.
• Any disputes will be resolved in the courts of Martin County, Florida.
